JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
Petitioner and co-accused, Rabindra Kumar were caught by the G.R.P. and allegedly, stolen attaichies were recovered from their possession. The prayer for bail of co-accused, Rabindra Kumar was rejected by this court on 21.12.2015 vide Cr. Misc. No. 57375 of 2015.
Submission on behalf of the petitioner is that petitioner is in jail custody since 07.10.2015 and does not have any criminal antecedent. It is further submitted that there is no substantive progress in the trial of the petitioner and moreover, he
Patna High Court Cr.Misc. No.12355 of 2016 (2) dt.18-03-2016 2/2 has sufficiently been punished by remaining in jail custody for more than five months.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur at Saran in connection with Sonepur/Hajipur Rail P.S.
