The present quashing application is filed by the petitioner against order dated 09.12.2015, passed by learned Principal Judge, Family Court, Katihar in Maintenance Case No.23 of 2015 directing the petitioner to pay interim maintenance allowance of Rs.2000/- per month to wife and further direction to pay Rs.5000/- for treatment of his minor son. The petitioner earlier approached this Court by filing quashing application vide Cr. Misc. No.2060 of 2016 and the same was disposed of by this Court by order dated 09.08.2016 with observation but without any substantive progress in the matter again the same order has been challenged, so this application is not maintainable. The petitioner is directed to pursue the matter before the Family Court, Katihar and the Family Court, Katihar is also
Patna High Court Cr.Misc. No.63069 of 2017 (2) dt.05-01-2018 2 /2 directed to dispose of the application in view of earlier observation given by this Court by order dated 09.08.2016 and consequently pass final order in the matter preferably within a period of six months from the date of receipt/production of a copy of this order. Both parties are expected to co-operate the court below in disposal of the case and no unnecessary adjournment shall be granted. Accordingly, the application stands dismissed as not maintainable.
