====================================================== CORAM: HONOURABLE MR. JUSTICE JYOTI SARAN ORAL ORDER 14-03-2016 Heard Mr. Shashi Bhushan Singh, learned counsel for the petitioners, learned counsel for the State and learned counsel for the State Election Commission.
The grievance of the petitioners is that their wards have been changed.
The two petitioners are voters of Gram Panchayat Raj, Jamin Mathia, Block- Minapur in the district of Muzaffarpur and whereas the ward of petitioner No.1 has been changed from Ward No.1 to Ward No.3, that ward of petitioner No.2 has been changed from Ward No.4 to Ward No.3.
Mr. Singh learned counsel for the petitioners has with reference to a representation present at Annexure-3 submitted that
Patna High Court CWJC No.4980 of 2016 (2) dt.14-03-2016 2/2 a detailed representation was given by the two petitioners along with a large number of voters complaining of change of their respective wards and although they were handed over a correction slip present at Annexure-2 showing that their wards have been corrected but it does not bear the signature of the authorities. The limited grievance of these petitioners along with those whose signatures finds mentioned in the representation present at Annexure-3 series is that their respective wards should be restored in the light of the details present at Annexure-2.
Having heard learned counsel for the parties and considering the limited grievance raised herein, the District Magistrate-cum-Collector, Muzaffarpur is directed to consider the grievance of the petitioners and to take appropriate steps for restoration of the wards of these persons whose names find mentioned in the representation present at Annexure-3 by restoring their wards in terms of Annexure 2 which is stated to be in tune with the electoral roll of 2011, unless he has his reasons for not doing so.
Since the grievance is very limited hence this Court would expect an expeditious disposal preferably within one week of receipt/production of a copy of this order.
The writ petition is allowed.
