JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 Earlier the prayer for bail of the petitioner was rejected vide order dated 30.08.2017 passed in Cr. Misc. No. 31735 of 2017 with a direction to the learned trial court to expedite the trial and try to conclude it within a period of one year.

The petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 137 of 2017, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that the period of one year has already been expired and no witness has been examined in this case.

Heard learned A.P.P. also.

No.9787 of 2019(4) dt.27-03-2019 2/2 Having heard both sides, perused the record from which it appears that the allegation against the petitioner is of causing death of his father and in this case charge has been framed, but no witness has been examined uptil now. In view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner.

However, the learned trial court is directed to expedite the trial and the Senior Superintendent of Police, Patna, is also directed to produce the witnesses in the court below. (Vinod Kumar Sinha, J) Amjad/- U T
