JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being younger brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 328,302 and 120B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 14 years of marriage by administering poison. It is submitted by the learned counsel for the petitioner that only on suspicion the entire in-laws family has been made accused in the present case. The petitioner claims to be separate from the husband of the victim and the informant is not the eye witness to the occurrence. The impugned order also does not suggest any direct material collected during investigation against

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Jalley P.S. Case No. 95 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
