JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned Counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Sahajitpur PS Case No. 95 of 2017 registered under Sections 341, 323, 354, 379 and 504/34 of the IPC.

Learned Counsel for the petitioner submits that admittedly there is land dispute between both sides as they are agnates so false allegation is levelled against the petitioner and there is no any cogent explanation why the FIR was lodged after a delay of three days. The petitioner has got no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Anil Prasad @ Amala Prasad in the event of his arrest or surrender before the court below within four weeks

Patna High Court Cr.Misc. No.52999 of 2017 (2) dt.09-11-2017 from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIII, Saran in connection with Sahajitpur PS Case No. 95 of 2017 subject to the conditions as laid down under Section 438(2) Cr.P.C..
