Mr. NAND KISHORE PD ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-02-2018 After some arguments, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to file regular bail application.
Accordingly, I direct that the petitioner shall surrender within a period of four weeks before the court below and apply for regular bail which shall be considered and disposed off on the same day considering the fact that there is no medical evidence with regard to commission of rape on the victim girl as also considering the fact that no rape has been committed by the petitioner herein which is proved from the case diary and the FIR itself and also the fact that on the alleged date of occurrence the petitioner was not present at the place of occurrence but was giving examination elsewhere.
The petition is disposed off as withdrawn.
