The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.
Allegation against the petitioner is that she appointed as a Prakhand teacher in Middle School Bhindi, Kalyanpur on the basis of forged document.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. The petitioner has already been dismissed from her service which is mentioned in para-10 of the petition. A statement has been made in para-3 of the
Patna High Court CR. MISC. No.58652 of 2022(2) dt.16-01-2023 2/2 petition that the petitioner has got no criminal antecedent. She is languishing in judicial custody since 7.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kalyanpur P.S. Case No. 311 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur.
