JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,504 and 506 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that the accused persons came, abused by calling caste name and made assault to the informant, informant's son and outraged the modesty of the sister in law of the informant.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.55313 of 2015 (2) dt.07-12-2015 2/2 that at earlier point of time Complaint Case no. 191 of 2006 and Raffiganj P.S. Case No. 59 of 2009 were registered by the petitioners side against the informant side. It is further submitted that in the background of dispute with regard to flow of water the accusation has been levelled.
Considering the case lodged by the petitioners side at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Raffiganj P.S. Case No. 135 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
