The petitioners seek pre-arrest bail in connection with Makhdumpur P. S. Case No. 184 of 2017 registered under Sections 147, 148, 109 and 353 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that save and except the fact that the petitioners'

Patna High Court Cr.Misc. No.58887 of 2017 (2) dt.13-12-2017 2/2 presence was found at the place of occurrence, there is no other material to connect the petitioners with offence under section 353 of the Indian Penal Code. He submitted that from perusal of the FIR itself, it would be manifest that it was one Sanjeev Kumar @ Bande Yadav, who was instrumental in instigating people and causing road blockade.

Learned Additional Public Prosecutor for the State has opposed the prayer for grant of pre-arrest bail to the petitioners. Having regard to the nature of allegation, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jehanabad in Makhdumpur P. S. Case No. 184 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
