ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.07.2019 in connection with Itarhi P.S. Case No. 176 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made not from the conscious possession of the petitioner but from the shop of one Arbind Kumar. It is further submitted that petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his

Patna High Court CR. MISC. No.55214 of 2019(2) dt.13-09-2019 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II- cum - Special Judge, Excise, Buxar, in connection with Itarhi P.S. Case No. 176 of 2019.
