2. In the present case, the petitioners seek bail in connection with Danapur Rail P.S. Case No. 91 of 2025, registered for the offences under Sections 303(2), 319(2), 318(4), 317(5), 111, 3(5) of the BNS.
3. As per the prosecution case, petitioners Sanjay Sharma and Md. Sarfaraj were apprehended by the rail police on the basis of their suspicious movement. Some stolen articles were recovered from their possession. They disclosed the name of petitioner Md. Akram for being their associate.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Nothing incriminating has been recovered from person or possession of the petitioners. The petitioners were apprehended while they had not been doing any illegal act nor they were planning to do so. No person came forward to state that he was cheated or defrauded by the petitioner. No stolen articles were recovered from the possession of the petitioners. The petitioners are in custody since 22.03.2025 and charge sheet has been submitted. Petitioner no. 1 and 3 are having antecedent of one case each and petitioner no. 2 is having antecedent of five cases. The petitioners are on bail in all the cases.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet and period of custody of the petitioners, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. (Railway), Patna/concerned

(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
