JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.08.2015 in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

The petitioner was caught with motor cycle on 11.08.2015 and on the same day before institution of the present case, the petitioner disclosed that he had purchased the aforesaid motor cycle from one Binod Ram who had not given documents of the aforesaid motorcycle. Petitioner does not have any criminal antecedent and is languishing in jail custody since 12.08.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
