The petitioner seeks pre-arrest bail in connection with Katihar (Town) P. S. Case No. 573 of 2015 registered under Section 273 of the Indian Penal Code and Section 47 of the Excise Act.

It is contended that the petitioner has no concern with the seventy three bottles of countrymade liquor recovered from her house. It was her son Bhola Mahaldar who was involved in the offence and he has already been granted bail by the learned Sessions Judge. It is further contended that the petitioner is an old widow having no criminal antecedent.

Regard being had to the facts and circumstances of the

Patna High Court Cr.Misc. No.54598 of 2015 (2) dt.09-12-2015 2/2 case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in Katihar (Town) P. S. Case No. 573 of 2015, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
