The petitioner is apprehending his arrest in connection with Nathnagar P.S.Case no.419 of 2018 , registered for offences punishable under Sections 498A, 341, 342, 323, 354B, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of subjecting the informant of cruelty with respect to demand of dowry. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her but the informant is not ready to live with the petitnoer.

Heard learned A.P.P. , who has opposed the prayer for bail..

Having heard both sides and in view of the facts and

No.6481 of 2019(4) dt.01-04-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Bhagalpur in connection with Nathnagar P.S.Case No.419 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure, with further condition that if any maintenance case is filed by the informant, the petitioner shall co-operate in disposal of the same otherwise the informant is at liberty to move for cancellation of the bail bond of the petitioner..

With the aforesaid observation, this application is allowed.
