====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Pakaridayal P.S. Case No. 18 of 2024 dated 17.01.2024 registered for the offences punishable under Sections 302, 201, 202 and 120B of the I.P.C.

3. As per the prosecution case, the informant states that U.D. Case No. 02 of 2023 which was lodged on 05.01.2023 for the death of one Munni Kumari, wife of Arvind Yadav, was handed over to him for investigation. The postmortem report of the deceased revealed the cause of death as Asphyxia due to strangulation, suggesting foul play. It is further alleged that on investigation, it has come to light that the deceased had frequent

Patna High Court CR. MISC. No.63344 of 2024(5) dt.18-02-2025 2/3 quarrels with her husband and in the backdrop of a conspiracy, the petitioner alongwith other co-accused committed her murder.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is the father-in-law of the deceased. It is further submitted that the family members of the deceased did not mention anything against the petitioner or any of the accused persons for any demand of dowry, and as such, there was absolutely no occasion for commission of such act. He is separate in mess and property from the husband of the deceased. There is general and omnibus allegation against the petitioner. The specific allegation is against the husband of the deceased. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 01.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of
