The petitioner is in custody since 23.06.2019 in connection with Lakhanaur P.S. Case No. 244 of 2018 for the offence registered under Sections 353, 406, 420, 467, 468 and 469 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case against the petitioner is false and fabricated and in fact he is the owner of the Plot No. 10150 and has nothing to do with Plot No. 10188 over which there appears to be some dispute. It is further submitted that the petitioner has also instituted a case under Section 144 Cr.P.C. against Rameshwar Saday and at the instance of the said Rameshwar Saday, the present case has been instituted against the petitioner.

No.54921 of 2019(2) dt.05-09-2019 2/2 Considering the nature of allegations made against the petitioner and that the entire dispute appears to be one of civil nature which shall be addressed by the Court of competent jurisdiction and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st Jhanjharpur, District Madhubani in connection with Lakhanaur P.S. Case No. 244 of 2018.
