The petitioner seeks bail in a case registered for the offence punishable under Sections 30 (a), 38(i) of the Bihar Prohibition and Excise Act, 2016 and Section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 80 litres country made liquor was seized. Petitioner is in judicial custody since 26.06.2019.

Considering the fact that the petitioner has no criminal antecedent and having 80 litres of country made liquor was seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 25,000/- (twenty five thousand) in the

Patna High Court CR. MISC. No.55441 of 2019(2) dt.02-09-2019 2/2 Court below and on deposit of the same, the court below shall release the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Khusrupur Police Station Case No. 229 of 2019 (Special Case No. 6318 of 2019).

The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
