The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Mohiuddin Nagar P.S. Case no. 208 of 2021 instituted for the offence under Sections 341, 342, 323, 354, 379, 307, 504 and 506/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner has assaulted son-in-law of the informant with knife causing injury on his head. It is further alleged that he also looted Rs. 7,000/- from the house of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. As per impugned order, doctor has found one incised

No.70288 of 2021(4) dt.23-08-2022 2/2 wound on left parietal region on the person of injured which is simple in nature and injury no. 2 is pain and swelling and nature of injury is grievous caused by hard and blunt susbtance, but in FIR, nature of weapon is sharp cutting, which is contradictory. which is contrary . Other co-accused persons have been allowed bail by lower court vide ABP No. 2269 of 2021. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mohiuddinnagar P.S. Case no. 208 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-iv, Samastipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
