The petitioner seeks anticipatory bail in connection with Beldaur P.S.Case No. 06 of 2018, registered for offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that with intention to grab the land of the informant, the accused person sold the land under conspiracy prepared a forged document.
Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in the present case and the co-accused Tribhuwan Singh and Gopal Singh were the bonafide sellers and the petitioner and others were the bonafide purchasers as there is land dispute between the parties vide Title
Patna High Court Cr.Misc. No.2373 of 2019(3) dt.04-02-2019 2/2 Suit No. 28 of 2017 and the petitioner has no criminal antecedent. It is further submitted that the petitioners are ready to abide all conditions imposed by the Hon'ble Court upon him. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Beldar P.S.Case No. 06 of 2018 to the satisfaction of Miss Simmi Kujur, the learned Judicial Magistrate 1st class, Khagaria, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
