The petitioner is apprehending arrest in a case registered for the offences punishable under sections 393 of the Indian Penal Code.

The accusation is of making attempt to rob the motorcycle of the informant when the accused persons escaped from the scene after snatching mobile of the informant. It is submitted by the learned counsel for the petitioner that the FIR was lodged against unknown. Name of the petitioner sprang up during investigation and there is no material except confession of co accused Mahtab. More over, no recovery has been made from the petitioner and co accused Mahtab has been granted regular bail.

Patna High Court Cr.Misc. No.56037 of 2015 (2) dt.10-12-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Chiraiya (Shikarganj) P.S. Case No. 8 of 2013 pending in the court of learned JM Ist Class, Sikrahana at Dhaka, East Champaran.

This application is disposed of with the aforesaid observation/direction.
