The petitioner seeks bail in connection with Special Excise Case No.505 of 2021 arising out of Bounsi P. S. Case No.144 of 2021, instituted for the offences under Sections 30(a), 32(2)/ 34 of the Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 448.56 litre of liquor from a pick-up van.

The learned counsel for the petitioner submits that petitioner is neither the owner, nor the driver of the pick-up van

Patna High Court CR. MISC. No.69606 of 2021(2) dt.25-02-2022 2/2 and had merely taken lift and came to be implicated when search was made, as such, petitioner was not knowing what was loaded in the vehicle.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Banka in connection with Special Excise Case No.505 of 2021 arising out of Bounsi P. S. Case No.144 of 2021.

The application stands allowed.
