JUSTICE SANJAY PRIYA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioner and the State. The petitiones apprehend arrest in Karjain P.S. Case No. 57 of 2015 instituted for the offence under Sections-363, 366A/34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. As per written report, there is allegation against this petitioner that he along with two other persons used to visit the house of the informant and has taken the minor daughter of the informant, Pinki Kumari who did not return till date. The informant has further alleged that he also found a love letter written by this petitioner to his minor daughter.

It has been submitted on behalf of the petitioner that the alleged occurrence is said to have taken place on 17-07-2015 whereas the written report has been filed on 24-09-2015.

In the written report, there is specific allegation against this petitioner of taking away the minor daughter of the informant. Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
