1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Nautan P.S. Case no.74 of 2022 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, the informant states that he received information about the three accused persons including the petitioner herein having hidden liquor in the bushes. On search, 306 litres of liquor was recovered.

4. It is submitted by learned counsel for the petitioner that neither any recovery has been made from the possession of the petitioner nor from his house. The alleged recovery is from a public place accessible to all. The cause of

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR, the petitioner being in custody since 26.7.2023 and grant of bail to similarly situated coaccused, the Court directs the petitioner to be enlarged on bail in connection with Nautan P.S. Case no. 74 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Court-II, Siwan.
