====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 27-07-2016 Heard the learned counsel for the petitioner. It appears that injunction application was filed by the respondent praying for injunction restraining the petitioner from transferring the property. The trial Court after hearing the parties and considering the fact that both parties agreed to maintain status quo during the pendnecy of the suit except the property mentioned in plot No.1321 measuring 5 acre 88 decimal, directed the parties not to transfer the property without permission of the Court. The petitioner file Appeal before the lower appellate Court. The lower Appellate Court by the impugned Judgment has dismissed the appeal considering all these aspects of the matter. Moreover, the trial Court has held that without permission, the parties cannot transfer and in such circumstances, I do not find any reason to interfere with the impugned order, particularly when it is observed by the trial Court that with consent of the parties, the
Patna High Court CWJC No.6541 of 2016 (2) dt.27-07-2016 2/2 order has been passed.
Thus, this writ application is dismissed.
