The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act and Section 25(1-B) a, 26, 35 of the Arms Act.

There is recovery of 59.280 litres of Indian made foreign liquor from a shop Khusbu Sweets and owner and staff of the said shop have been apprehended. The petitioner is alleged to be the supplier of illicit foreign liquor.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.69794 of 2021(3) dt.06-07-2022 2/2 petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The co-accused person who named the petitioner was on inimical term with the petitioner.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Vaishali (Belsar O.P) P.S. Case No. 255 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
