The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code. For trivial dispute, there is general and omnibus allegation of commission of assault against more than twelve persons. Specific allegation against the petitioner is that he put his pistol near the temple of the informant. However, there is no allegation of firing. Petitioner has got no criminal antecedent. Submission is that for trivial dispute between the two neighbours, false case has been lodged.
Considering the nature of allegation and material available, let the petitioner, above named, in the event of his
Patna High Court Cr.Misc. No.2189 of 2019(2) dt.16-01-2019 2/2 arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Harsidhi Police Station Case No.334 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
