JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 504, 406, 420 and 506/34 of the Indian Penal Code. The prosecution case is that the petitioners and their brother Dharmendra Kumar took `1,55,200/- from the informant on promise to return the same within one month, subsequently, a cheque was issued for repayment which got bounced due to insufficient fund.
It is submitted by learned counsel for the petitioners that there is nothing on record to suggest that the money was borrowed by the petitioners and the cheque was admittedly issued by the
Patna High Court Cr.Misc. No.55657 of 2015 (2) dt.08-12-2015 2/2 brother of the petitioners Dharmendra Kumar. Alleged cheque is the part of FIR. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the thrust of accusation against Dharmendra Kumar, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Munger in connection with Dharhara P.S. Case No. 81 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
