JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-02-2023 Heard learned counsel for the petitioners and the learned A.P.P. for the State as well as learned counsel for the Informant.

The petitioners apprehend arrest in connection with Complaint Case No. 543 of 2022 registered under Sections

Patna High Court CR. MISC. No.62189 of 2022(5) dt.06-02-2023 2/2 304B and 201 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are father-in-law, mother-inlaw, Devar, married Nanad and cousin father-in-law of the deceased respectively. They are innocent and have falsely been implicated in the present case. The deceased died during the course of treatment. She was suffering from abdominal pain, vomiting and other complications on account of which she was admitted to Ruban Hospital in I.C.U., as evident from Annexure-2 to the bail application. Further he submits that all the expenses of the treatment of the deceased have been paid by the petitioners as well as father of the complainant on different dates, which is evident from Annexure-3 to the bail petition.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of the Judicial Magistrate-II, Nawada in connection with Complaint Case No. 543 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
