JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-12-2017 Heard learned counsels for the petitioners and State. It is submitted that petitioner no.2 has been arrested, hence the present application with regard to petitioner no.2 has become infructuous.
Accordingly, the present application with regard to petitioner no.2 is disposed of.
The petitioner no.1 is apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 307, 341 and 504/34 of the IPC.
The prosecution case is that on 12.09.2017 at 8.30 PM, the informant was at his grocery shop along with his father, in the meanwhile, the neighbour of the informant, namely, Md. Rahman came to his shop and demanded domestic articles on
Patna High Court Cr.Misc. No.62073 of 2017(2) dt.22-12-2017 2/3 credit which the informant refused, since he had not cleared the early dues of Rs. 7-8 thousand, thereafter, Md. Rahim, petitioner no.2 abused the informant. It is further alleged that co-accused Md. Rahman started abusing the informant from his door and when the informant protested, co-accused Md. Rahman armed with dagger, petitioner no.2, Md. Rahim armed with danda and the petitioner no.1 attacked the shop of the informant and assaulted the informant, as a result of which, the informant received substantial injury on the chest, stomach and other parts of the body. The other accused persons assaulted the informant and his father with danda.
It is submitted by learned counsel for the petitioner that no specific accusation has been alleged against petitioner no.1, who is a lady. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Considering the fact that the accusation against petitioner no.1 is omnibus and general, let the above named petitioner no.1 be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Begusarai in connection with
