Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and the learned counsel for the informant.
Petitioner is named in the first information report but according to the prosecution case itself, it were co-accused Raghvendra Krishna Pandey, Ram Krishana Pandey and Hara Krishana Pandey, who assaulted the deceased and so far as petitioner is concerned, it is only stated that he was instigating the other accused and when the informant made attempt to rescue the deceased, he was assaulted by the petitioner. No doubt, earlier petitioner was convicted and sentenced to undergo rigorous imprisonment for 10 years in a criminal case but appeal filed by the petitioner against the same is
Patna High Court Cr.Misc. No.15502 of 2016 (2) dt.18-04-2016 2/2 still pending before this Court. Furthermore, the alleged occurrence appears to have taken place due to previous enmity. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dumaron P.S.Case No. 401 of 2015.
