The petitioner seeks bail in a case registered for the offences under Sections 341, 323, 324, 325, 307, 504, 506, 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.07.2021, charge-sheet has been submitted and has antecedent of one case, further it is submitted that the informant alleges that three main accused persons along with ten unknown assaulted his father who became unconscious and later on died during the course of investigation. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and

Patna High Court CR. MISC. No.69624 of 2021(2) dt.26-04-2022 2/2 similarly situated co-accused, Azad Paswan, has been granted bail by order dated 19.03.2020 passed in Cr. Misc. No. 87048 of 2019. It is also submitted that the allegation of assault is general and omnibus in nature and no motive has been assigned for the occurrence.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact the petitioner is in custody since 08.07.2021, charge-sheet has been submitted and co-accused has been granted bail by the Coordinate Bench of this Court, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Imadpur P.S. Case No. 55 of 201, with a condition that one of the bailor shall be the father of the petitioner (Pathak Paswan).

The application stands allowed.
