The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 41(i) and (ii) of the Bihar Prohibition and Excise Act, 2016. At the outset it is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 17.9.2021 (Annexure-1) passed in Cr. Misc. no. 22306 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner being in custody since 24.12.2020 has remained in custody for more than one year.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the materials on

Patna High Court CR. MISC. No.69802 of 2021(2) dt.05-01-2022 2/2 record, the liberty granted by the aforesaid order dated 17.9.2021 and the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Kalyanpur P.S. Case no. 311 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge (Excise), Samastipur.
