JUSTICE BIBEK CHAUDHURI ORAL ORDER 09-09-2024 Pursuant to the employment notice of 03 of 2022 for appointment on the post of Court Reader-cum-Deposition Writer, petitioner offered her candidature. She passed in preliminary test and appeared in the written examination. The written examination consisted of multiple choice questions, answers of which were to be given on OMR sheets and descriptive type questions. In the OMR sheet the petitioner failed to fill in the bubbles containing the question booklet series. For this reason, OMR sheet was treated to be invalid and cancelled. Similarly, in respect of some other candidates also the OMR sheet was treated to be invalid on the same ground. Subsequently, the said candidates submitted representation

Patna High Court CWJC No.13200 of 2024(2) dt.09-09-2024 2/3 before the Convener, Centralized Selection and Appointment Committee-cum-District and Sessions Judge, Patna. The Convener vide Annexure P/4 at page 30 of the instant writ petition, passed an order on 09th May 2024 in following words:- "In view of resolution of the 'Centralized Selection and Appointment Committee' dated 07.05.2024 duly approved by the Hon'ble Court, the following 17(Seventeen) candidates, whose OMR sheets were not evaluated as the same were found invalid, but have secured minimum qualifying marks, i.e., 36 marks in the Answer script of descriptive type questions, are declared as qualified in the 'Written Test' held on 17.03.2024 in connection with appointment to the post of Court Readercum-Deposition Writer in the Civil Courts of Bihar pursuant to the Employment Notice No. 03/2022........"

2. The petitioner has approached this Court for consideration of her representation in the line of Annexure P/4.

3. I have heard the learned counsel for the petitioner as well as the High Court of Patna. The instant writ petition is disposed of directing the Centralized Selection and Appointment Committee to consider as to whether the petitioner secured the minimum qualifying marks, i.e., 36 marks in the answer script of descriptive types questions. If the petitioner secures the minimum qualifying mark, she is entitled to be considered for

4. The above exercise shall be made by the Committee within three weeks from the date of communication of this order. The final order shall be forwarded to the petitioner immediately after such consideration.

5. With the above direction, the instant writ petition is disposed of.
