JUSTICE ARUN KUMAR JHA ORAL ORDER 20-10-2022 Vide order dated 10.10.2022, an explanation has been called for from the learned trial court which has granted bail to the petitioner while the matter has been pending before this court, as to under what circumstances he passed the order granting bail.

A report has been received from the learned trial court wherein he has submitted that the petitioner while moving his bail petition before the learned trial court has specifically stated in paragraph 2 of the petition that the petitioner has filed Cr.Misc. No. 69811 of 2021 in the High Court which was withdrawn without any consideration and no other petition have been pending before the learned court below or any of the superior courts. The same fact also finds mention in the order dated 08.03.2022 by which the petitioner was granted bail by

Patna High Court CR. MISC. No.69811 of 2021(4) dt.20-10-2022 2/2 the learned Additional District & Sessions Judge-XIII, Saran at Chapra.

Obviously, the petitioner has made a wrong submission before the learned trial court.

Under the aforesaid circumstances, the learned trial court is directed to take appropriate action for making a wrong submission before it by the petitioner.
