JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Ekma P.S. Case No. 251/2018, disclosing offences under Sections 25 (1-b)a, 26 and 35 of the Arms Act. Police during the night patrolling intercepted a motorcycle, on which, three persons were sitting and on seeing the police two of them succeeded in fleeing away and one was caught and on search two live cartridges were recovered from his pocket and he disclosed the names of petitioner and another accused person, who succeeded in fleeing away. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and save and except the confessional statement of co-accused, there is nothing against the petitioner Learned counsel for the State opposed the prayer for
Patna High Court CR. MISC. No.64528 of 2019(2) dt.15-10-2019 2/2 anticipatory bail and submitted that apart from the confessional statement of co-accused, petitioner is accused in three more cases.
Having heard both sides, considering the facts and circumstances as well as the criminal antecedents of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
