The petitioner apprehends his arrest in Pipariya P.S. case No. 42 of 2019 registered under Section 448, 354B of the IPC and u/s 27 of the Arms Act.

The informant alleged that on 04.06.2019 at 12 in the night while she was sleeping the petitioner entered into her house and made all attempt to commit rape with her. The informant protested and caught the petitioner. Parmanand Singh, who was sitting on the door, came to save but the petitioner fled away firing from his pistol.

The learned counsel for the petitioner submits that son of the informant borrowed some money from the petitioner and when the petitioner demanded money the informant lodged this

No.59321 of 2019(2) dt.24-09-2019 2/2 case making false and frivolous allegation but on the face of the allegation it appears that the victim, who is a widow, made specific allegation that petitioner entered into her house at the dead of night and made attempt to outrage her modesty but somehow she saved herself by raising alarm.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
