JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-02-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 365, 302, 201/34 of the Indian Penal Code.

The prosecution case in nutshell is that elder son of the informant, namely, Vipin Bihari Ojha, after receiving a mobile call, went and he has not returned till date. It is further alleged that the informant has strong suspicion that his son may be kidnapped by unknown persons.

No.57942 of 2022(3) dt.17-02-2023 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. The petitioner is not named in F.I.R. and on the basis of confessional statement of co-accused Ajay kumar Choubey, the name of the petitioner sprang up in this case. Nothing has been recovered from the conscious possession of the petitioner. Moreover, petitioner is languishing in judicial custody since 22.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail and submitted that Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail.
