JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 406/420 of the Indian Penal Code.

As per the prosecution case, Rs. 10, 32, 500/- was transferred in the account of this petitioner for construction work under Nal Jal Scheme but he completed the work only for Rs. 9,53,534/- and rest of the amount is alleged to have been defalcated by this petitioner.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner is ready to deposit Rs. 80,000/- in the court below within two months from the date of his release, which shall be subject to final result of this case.

Patna High Court CR. MISC. No.4400 of 2022(2) dt.04-04-2022 2/2 Petitioner claims clean antecedent and is in custody since 11.07.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the period of custody of the petitioner and the undertaking given by the petitioner that he will deposit Rs. 80,000/- in the court below within two months from the date of his release, let the petitioner, above named, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Rohtas at Sasaram in connection with Kargahar PS case No. 13/2020, subject to condition that petitioner shall deposit Rs. 80,000/- in the court below within two months from the date of his release, which shall be subject to final result of this case. If the petitioner fulfills the aforesaid condition, the provisional bail granted to the petitioner shall be confirmed by the court below and he fails to fulfill the aforesaid condition, the court below shall cancel the bail bonds of the petitioner.
