The petitioner is in custody since 13.07.2019 in connection with Nokha P.S. Case No. 58/2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that only on presumption that his name was appearing on a chit of paper in which there was no mention of the name of the father of the said person or the full address, the petitioner has been taken into custody on mere suspicion that he is the same Jokhan Ram. Learned counsel for the petitioner further submits that the petitioner is a man of clean antecedent and nothing has been recovered from his conscious possession.

No.56754 of 2019(2) dt.24-09-2019 2/2 In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 58/2018.
