1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Samastipur (Muffasil) P.S. Case No. 127 of 2023 registered under Sections 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 30(a), 32, 36, 41(1) and 41(2) of Bihar Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is neither the driver nor the owner of the alleged vehicle from where the alleged recovery has been made.

4. Having considered the facts and circumstances of the

No.60640 of 2023(2) dt.16-10-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise-I, Samastipur in connection with Samastipur (Muffasil) P.S. Case No. 127 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
