The petitioner apprehends his arrest in connection with Belaganj P.S. Case no. 177 of 2017, registered under Sections 147, 149, 325, 307, 379, 504 and 506 of the Indian Penal Code. The accusation is that on 25.05.2017, Md. Aftab Alam @ Kallu and Md. Arif, husband and nephew of the informant, were present at his house. At that time, Dargahi Thakur and 13 persons named in the F.I.R. started to construct house near the house of the informant and they also started to abuse the husband and nephew of the informant. At that time, Ganesh Thakur caused blood oozing injury through iron rod at the head of the husband of the informant and Subodh Thakur (Petitioner) caused injury through Garasa in which husband of the informant become unconscious and other accused also caused injury through bricks. No.54645 of 2017 (2) dt.16-11-2017 2/2 Jaimanti Devi snatched golden chain to the neck of the informant and Manoj Thakur, Santosh and Pawan Thakur took cash of Rs. 19,500/- from the pocket of the husband of the informant. Learned counsel for the petitioner submits that, in fact, occurrence of marpit took place due to land dispute in which petitioner's side also sustained injury regarding which Belaganj P.S. Case No. 176 of 2017 is instituted under Sections 147, 149, 341, 323, 325, 504 and 506 of the Indian Penal Code on the basis of the written report of the Subodh Kumar (Petitioner). Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Gaya in connection with Belaganj P.S. Case No. 177 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
