Petitioner apprehends his arrest in Basantpur P.S. Case No.13 of 2016 instituted for the offence under Section(s) 304-B, 201, 120-B Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Siwan.

Petitioner is husband of the deceased.

Counsel for the petitioner has submitted that the police after investigation submitted final form in this case. The Court below after looking into the case diary has taken cognizance against the petitioner.

The Sessions Judge has mentioned different paragraphs of the case diary in the impugned order. In such circumstances, this application is disposed

Patna High Court Cr.Misc. No.53304 of 2017 (3) dt.23-11-2017 2/2 off with direction to the petitioner to surrender before the Court below and pray for regular bail which shall be considered and disposed off by the learned Court below preferably on the same day and in the event no material is found in the case diary, in the paragraphs mentioned in the impugned order of the Sessions Judge, the Court below will pass appropriate order in accordance with law.
