The petitioner seeks bail in a case registered under Sections 341, 323, 354, 354(A)/34 of the Indian Penal Code and under section-10 of POCSO Act.

Allegedly, while eight years old grand daughter of the informant was playing with other children, on the pretext of watching television, the petitioner took her to his house and misbehaved with her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-09-2018. Charge sheet in this case has already been submitted. The petitioner is next door

Patna High Court CR. MISC. No.57374 of 2019(2) dt.11-09-2019 2/2 neighbour. The petitioner has been made accused in the present case due to previous enmity. The allegation, made in the FIR is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Ist-cum-Special Judge, Kaimur at Bhabua in connection with POCSO Registered Case No. 38 of 2018 arising out of Bhabua Mahila P.S.
