ANJANA PRAKASH ORAL JUDGMENT Date: 08-02-2016 The Petitioner seeks revision of the judgment of conviction dated 27.08.2015 passed by the Additional Sessions Judge-V, Danapur, Patna in Criminal Appeal No. 51 of 2012, by which he has affirmed the judgment dated 15.03.2012 passed by the Judicial Magistrate, 1st Class, Danapur, Patna in Danapur P.S. Case No. 466 of 2006 (Tr. No. 180 of 2012, G.R. No. 368 of 2006), by which he has convicted the Petitioner under Sections 406 and 420 IPC and sentenced him to undergo R.I. for three years. Considering that the Petitioner was not convicted under Section 138 N.I. Act, the judgment of conviction dated 27.08.2015 passed by the Additional Sessions Judge-V, Danapur, Patna be maintained but the sentence is reduced to the period already undergone by the Petitioner.

With the aforesaid observations, the application stands dismissed.
