JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This application, for grant of anticipatory bail, arises out of Deokund P.S. Case No. 29 of 2019, disclosing offences under Sections 494, 498(A) and 34 of the Indian Penal Code. Petitioner happens to be husband of the informant and allegation against him is that he left the house and performed marriage with another lady and started living with her and there is allegation against other accused persons of demand of dowry. Submission of learned counsel for the petitioner is that the allegation that petitioner has solemnized marriage with another lady is false and concocted and he is still ready to keep the informant with full honour and dignity.

Heard learned A.P.P. as well as learned counsel for

Learned counsel for the informant has submitted that as the petitioner has solemnized marriage with another lady, she is not ready to live with the petitioner. Having heard both sides, considering the facts and circumstances and also the fact that as per F.I.R the only allegation against the petitioner is that he started living with another lady and except that there is no allegation against him, as such, let petitioner surrender before the court below within to weeks from the date of receipt of this order, on which, the court below shall release the petitioner on bail on furnishing bail bond of Rs.

25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Aurangabad, in connection with Deokund P.S. Case No.
