The petitioner seeks bail in a case registered for the offences punishable under Sections 384, 385 and 386 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.08.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the informant alleges that on information received regarding extortion from auto drivers at Digha auto stand, the informant reached the place of occurrence and arrested Vikas (petitioner) from whom Rs. 320/- was recovered and accused Kundan managed to flee.

No.69909 of 2021(2) dt.26-04-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case merely because of his antecedents and no F.I.R. was instituted by any auto driver regarding extortion being committed by any accused persons including the petitioner.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.08.2021, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Digha P.S. Case No. 463 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Javahar Lal @ Jawahar Das. (Satyavrat Verma, J) Rishi/- U T
