JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 353, 307 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that cross firing was going on between two groups and when police party reached there, the aforesaid groups made firing on the police party also and taking advantage of the situation, the members of the aforesaid groups managed to escape from there. Some empty cartridges were recovered from the roof of members of the aforesaid groups. Petitioners are named in the first information report but no specific overt-act has been

Patna High Court Cr.Misc. No.13158 of 2016 (2) dt.01-04-2016 2/2 attributed against them. Moreover, it appears from the first information report that no person sustained injury in the alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Raghubir Prasad, Judicial Magistrate 1st Class, Ara, Bhojpur in connection with Shahpur (Bahoranpur) P.S. Case No. 273 of 2015.
