JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 18.12.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner was lodged in Sitamarhi jail and when the administration took attempt to transfer him from Sitamarhi to Central Jail, Buxar, the supporters of the petitioner and one Madhav Chaudhary created nuisance in the premises of Sitamarhi jail and made attempt to commit murder of jail officials. The contention on behalf of the petitioner is that no allegation has been levelled against the petitioner rather entire allegation centers around against supporters of the petitioner and one Madhav Chaudhary.

Moreover, some co-accused have already been granted privilege of bail.

No doubt, petitioner carries criminal antecedent of near about 20 cases but in the present case, there appears to be nothing

Patna High Court Cr.Misc. No.56920 of 2015 (2) dt.18-12-2015 against him.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case no. 285/2014.
