The petitioner is in custody in connection with Udwantnagar P. S. Case No. 238 of 2018 giving rise to G. R. No. 3093 of 2018 for the offenses under Sections 364, 365, 394, 411, 414/34 of the Indian Penal Code and 25(1)(B)(a) and 26/35 of the Arms Act.
Learned counsel for the petitioner would submit that similarly circumstanced other co-accused have been granted bail by this Court. The petitioner is in custody since 11.07.2018. Learned counsel appearing on behalf of the State has drawn the attention of the Court to Annexure-2 to contend that it is those persons who have been granted bail from whose
Patna High Court Cr.Misc. No.4619 of 2019(2) dt.29-01-2019 2/2 possession arms were not recovered, whereas, from the possession of the petitioner vide Annexure-2, loaded pistol was recovered.
Considering the fact that the petitioner has remained in custody for more than 6 months and also the fact that other co-accused have been granted bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwantnagar P. S. Case No. 238 of 2018 giving rise to G. R. No. 3093 of 2018. (Anil Kumar Upadhyay, J) spandey/- U T
